USCIS, on April 7, 2016 announced that the statutory cap of 65,000 visas for fiscal year 2017 has been reached. Also, It has received H1B applications more than the limit of 20,000 visas that have been filed under master degree cap.

Yesterday, USCIS announced that over 236,000 petitions have been received for H-1B FY 2017. On April 9, a random selection was used to select the h-1b petitions, to cover 65,000 general category petitions and 20,000 master degree petitions. It has been claimed by USCIS that all the unselected applications will be returned along with the filing fees.

On the very first note, USCIS conducted the random selection process for master degree cap. Then the applications that don’t get selected became part of general category cap i.e. 65,000 limit.

Petitions that are otherwise not liable for the cap will be accepted and processed by USCIS. Take a look on the petitions that will be accepted filed to:

• Employment change terms for current H1B workers
• Extension in the duration of an H1B workers to stay in the US
• Allowance to current H1B workers for changing employers
• H1B workers can work in second H1B position that require specialized knowledge in fields like computer programming, science and engineering
