Terrible News – EAD Cutoff Dates Moved Back!

Terrible news for i-140 EAD aspirants. USCIS has just published the revised cutoff dates for some categories. The cutoff dates for India EB2 has moved back from July 2011 to July 2009.

This is a terrible news for many EAD aspirants just 5 days before the filing date (Octpber 1, 2015).

Congratulations EB category applicants! USCIS introduced a new system for visa bulletin. Starting October, USCIS has introduced cutoff dates for filing I-485 applications.

What does it mean to you?

If your priority date is earlier than the acceptance cut-off date specified in the following chart, you can apply for I-485.  This is a Great NEWS!

Moving forward, the visa bulletin will contain Acceptance Dates and Final Action Dates.

Acceptance Date: You can file your I-485 if your priority dates crosses the Acceptance Date.
Final Cut off Date: Your GC will be approved if your priority date crosses the Final Cut off Date.

What are the benefits of this rule?

Here are the list of benefits if you apply for i-485:

  • EAD
  • Change employers easily (AC 21)
  • Avoid visa extensions and stamping

Employment-Based Categories
These categories are based on your level of work or study as you enter a country.

  • EB1 refers to priority workers. Persons of extraordinary ability in the sciences, arts, education, business, and athletics, outstanding professors and researchers and certain executives and managers.
  • EB2 refers to professionals holding advanced degrees, or persons of exceptional ability in the arts, sciences, or business.
  • EB3 refers to skilled workers and professionals holding baccalaureate degrees.
  • EB4 refers to certain special immigrants. These include religious workers, certain overseas employees of the U.S. Government, former employees of the Panama Canal Company, retired employees of international organizations, certain dependents of international organization employees and certain members of the U.S. Armed Forces.
  • EB5 refers to employment creation investors.

  1. Hi,my H1B had been expired on Nov2007.Now I am in different company. Suggest how to renew my H1B on my own since present company doesn’t want to proceed to renew even petition was accepted.

  2. I feel the Government practices racism on the name of which country I belong to. Why can’t I be merged in a common pool of immigrants?
    Why such a delay for GC after the EAD? Seriously how many Russians or europeans have been denied or prolonged like this? I feel this is based on the colour and the way we look more than the talent we have. I have been in this country for more than 15 years and a practicing physician now after training. Too bad to see such discrimination by POTUS. He has to atleast pay attention to people who have been working for such a long time.

  3. Can a person on L1B with an approved I140 apply for this EAD?

  4. Can you point to the source for this story? I could find the corresponding update in the USCIS website.

  5. 1. Who will file your EAD? self or current employer or prospective employer?
    2.Can you find a different employer to file your EAD if your current employer does not want to because of obvious reasons?

    the cutt off date is little confusing to me, can i apply for i-485 or not.
    My Priority date is Jan 2009 under EB3, can i apply it or not. ?

  7. Correct me If i am wrong As you can Include you wife when you file your i-485 I guess they are also eligible for EAD.

    This is not great news. What about people after 2011? Instead 140 EAD is the ultimate news. Request you to put this petition and ask people to sign it. We still need 66000 of those.

  9. Could you please let me know if the spouses who are on H1B can also apply for EAD?

    • I believe a big NO, since you are not an dependent on your spouse income anymore.

    • Greencard petition is a separate petition to your H visa applications. You can include the family/dependents on your I-485 and they will also get the EAD alongwith the main application holder. Please consult with your attorney to get the entire process information.

    • Yes, they can apply too.
