EB1 VISA PERMANENT RESIDENCY OVERVIEW

EB1 Visa, Employment Based Immigration: First preference EB-1 is a US employment based preference category for permanent residency. It is designed for priority workers. These workers are foreign nationals who may be outstanding researchers or professors, individuals with extraordinary ability, or multinational managers or executives who have been transferred to the US. Each category would have to meet certain criteria to be accepted into the EB1 permanent residency category.The EB-1 permits them to permanently remain in the US.

EB1 Category – Who can Apply?

EB-1 is granted to three categories of foreigners:

  • Outstanding researchers and professors: Their exceptional academic achievements in a specific field should be recognized internationally. They need also to have a minimum of three years teaching or research experience in the particular academic area.
  • Extraordinary ability in arts, sciences, athletics or business that has been verified by sustained international or national acclaim.
  • Managers and executives of multinational companies who have been transferred to the United States. They must show that they have been employed in the past three years.

Eligibility Criteria

Outstanding Researchers and Professors Category

One should include at least two of the below documentations and an employment offer from a U.S employer.

  • Membership evidence in associations which demand their members to show outstanding achievement.
  • The receipt of evidence showing major awards and prizes for exceptional achievements.
  • Participation evidence in academic works.
  • Professional publications evidence.
  • Scientific research contributions evidence.
  • Authorship of scholarly articles or books evidence.

Extraordinary Ability Category

One must fulfill 3/10 of the below listed criteria to qualify under this category.

  • Membership evidence in associations in the field which demand their members to show outstanding achievement.
  • Receipt of evidence of recognized awards or prizes for excellence.
  • Evidence of commanding high remuneration or salary as compared to your colleagues in the field.
  • Evidence of having been participated, either in a panel or individually, to judge other people’s work.
  • Proof of published material about yourself in a major trade publications or professional publication.
  • Proof of genuine scholarly, scientific, athletic, artistic, or business related contributions of key importance to the field.
  • Authorship of scholarly articles or major trade publication evidence.
  • Commercial success evidence in the particular performing art.
  • Evidence of having showcased your work as showcases or artistic exhibitions.
  • Evidence of having played a critical role in a reputable organization.

Multinational Executive or Manager Category

The following criteria must be met to qualify under this category.

  • The employer petitioning ought to be a United States employer.
  • Your employer ought to have been in the business for a minimum of 1 year, as a subsidiary, an affiliate, or same legal entity or other corporation that hired you abroad.

 The Process of Applying

  • Outstanding Researchers and Professors: The employer should file Form I-140, Petition for Alien Worker.
  • Extraordinary Ability: You can file Form I-140, Petition for Alien Worker yourself.
  • Multinational Executive or Manager: The employer should file USCIS Form I-140, Petition for Alien Worker.

 EB1 Priority Dates – Current Scenario

The EB1 Priority Dates as of today is “Current” for most of the countries including India and China. Typically an applicant would receive permanent residency in around an year if applied under EB1 Category.
