  3. Isn’t LCA for H1B & LC for GC ? Can you change the word LCA in the flow chart image to LC ?

  4. I am currently a student in the USA with a F1 visa and I am working as part as my CPT. My employer is petitioning for a EB2 green card, but according to this chart that’s not possible.

  5. The pictorial is wrong and misleading. You can apply for EB-2 even if your employer is not ready to support the process i.e. apply for a national interest waiver. An alien may apply for permanent residence status (Green Card)
    and seek a waiver of the offer of employment by establishing that his orher admission to permanent residence would be in the national interest.

    The national interest waiver is a good option for those who do not wish to wait several years for labor certification or those who do not wish to be tied to a specific employer during labor certification.
    The national interest waiver applicant sponsors him or herself and is
    not required to have a job.

  6. Regarding filing EAD along with I-140 once priority date is current… Do you know if this applies for H-4 visa holders?

There are many H1 or L1 or WhoKnows1 kind of visa holders in my community and they always ask us “Green Card Aaa Gaya?”…….This is so funny because I hardly speak any other language than English. When I say we dis not come here on H1, L1, X1 visa and we already became US citizen few decades ago then they just don’t like that. Funny dudes specially seeing them in sports shoes with dress pents.

  12. Thanks for the great info- One quick question- I am on L1B Visa (in last year of expiry) and my employer is willing to apply for a Green Card. My wife is working on L2 Visa, and once the Green Card application is submitted, I understand the visa status can be renewed, on those lines can my wife’s L2 Visa be renewed along with her EAD ? Just checking so that both of us can be working while the lengthy process.

          • if you’re talking about legal vs illegal then you should check your information about H1 and L1 visas the government allows H1 and L1 holders to apply for an Employment Based Green card thus allowing them to apply for citizenship after 3-5 years depending on their status

I just had a quick question – So, once I-140 is approved, do we need the Dates to be current to go through the Consular Processing? Also, are there any eligibility requirements to go through the Consular Processing? Please advice. Thanks!!!

    • Thanks for this information! really helpful! My question is… as a H1b holder can I apply for the greed card at any time, or should I have a minimum time working as a H1b?? thank you

      • You should have atleast 2 years of work experience since we have to submit our past work experience records (experience letters and references) , If you have already 2 years of experience and your employer is ready to file your GC , you are good to go.
