USCIS excuses late Filing for H-1B

The Federal Government shut down ended last Thursday, October 17th 2013 there by the government resuming the regular operations. This shut down has largely impacted those non-immigrants who were filing for an H-1B Extension or H-1B transfer since the Department of Labor was also partially shut down.

Since LCA needs to be filed for the same, candidates might not be able to catch up with the deadlines due to the shut down. USCIS is now accepting late petitions for H-1B if failed to timely file due to Government Shutdown.

USCIS Excuses Late Filings

USCIS (United States Citizenship and Immigration Services) will now consider those petitions failed to timely file due to the Government Shut Down. Below is the post from USCIS, which explains when a particular filing could be considered to be failed to submit timely due to the shutdown.

If you could not timely file your H-1B petition extension or transfer due to the government shutdown, hurry up and inform your employer to provide evidence in order to consider your petition at the USCIS.
