This is a deportation story shared by an H-1B visa holder recently.

Hi All-

I’ve been working in Chicago from past 5 years working at a Client ‘A’ through a Vendor ‘B’. Until 2010, I was working with same client and same vendor but with original petitioner who is not located in chicago. In 2010, transferred my H1 to a different company who is unfortunately (will tell you why) located elsewhere than chicago but with same client and vendor. Everything was going smooth until Sept 2013.

After few weeks of vacation, was travelling back with family in sept 2013. At the port of entry, officers found upon 3 hours wait and 2 hours discussions that employer employee relationship does not exist and made me withdraw admission and made me pay for tickets and sent back. Its a different story altogether how our airport people treat a ‘deportee’.

Here are the few questions and i dont know which one triggered the event.

Why are you coming here when your employer is elsewhere?
Who is your client?
How many employees of your employer work at your client site?
Who assigns day to day work to you?
Do you have a client identification card?
Do you have a client letter?
Why did you go to Canada for stamping?
..

Thats the first round of questions at the port of entry counter. He took us to a room where they made us wait for 3 hours and questioned for another 2 hours. After that, they made me withdraw admission and made me pay for tickets and sent back.

So folks, If you are falling under above scenario,

1) Better go to your employer’s place first and then go to your client site.
2) Don’t go to Canada or Mexico for H1B stamping. I heard this rarely triggers everything.
3) If you have not visited your employer location once, make a visit, understand the demographics.

90% H1Bs are in my situation and i was only the one caught. So just be prepared.

    I am in a situation with lot of confusion. your Advice will help.

    I am working with current Company A which had sponsored my H1B. it is valid till Sep 2016. I went to US, SFO on June 2014 and returned back on Dec 2014 to India. Company A did not give any Paystubs, but paid my Indian Salary and gave per-diem for the duration of stay from June 2014 till Dec 2014. So i do not have any US paystub. But i have indian Salary Paystubs during that period.

    Now a Consultant B – Small consultant has offered me a Job to the same location SFO with Client Letter and also transferred my H1 B to the Company B. I have resigned from Company A and serving the notice period.

    I am travelling to SFO during May end

    Clarification required on below

    1) Will there be any issue at SFO port of entry since i do not have US pay stubs of Company A during my previous stay.

    2) If Company A has revoked my First H1. will this cause an issue at POE.

    3) Since the Company B is small but has got valid client letter to work in SFO. will this cause any issues at SFO port of entry since H1B transferred to comany B.

    4) If Company A has not revoked and the H1 is still valid. Can i use that H1 to enter US.

    your urgent response will be appreciated highly to decide my future course of action. I am in complete deli-ma Please help on this regard

  2. it’s good, coz all h1 visa holders are pricks. u all get over 100k , and given the chance to that and u don’t appreciate it, i would support deporting all of H1 holders

  3. Curiously, did the officer at the port of entry call your employer for clarification? Why not? Why didn’t you suggest so?

    In this case, I suspect that your employment contract was near its end or you were recently terminated for whatever reason. Seems like your boss or manager didn’t want you to return to USA therefore they inform the officer that your role was no longer required in the USA.

    I know things are tough at the border control these days due to terrorism activities but still, majority of the officers are reasonable enough if you have good documents (employment contract, a letter from the manager, a good bank account) to prove that you were needed.

    However, I wouldn’t say that those officers are the most polite people on Earth …… I decided that I would never step into USA ever again for the rest of my life after the last unpleasant encounter. I don’t like rude people, that’s all.

    this will happen if you have your visa through a desi company ..whos main goal is fake resumes and put freshers on client with 10 yrs of experince. multiple layers and all. i believe USCIS should be more strict with such cases to remove fradulent visa applications like your.

And what crap are you talking about people getting paid less, which world are you living in , I stay in california, and I make about 120K , even after the vendor and the employer takes their cut.   9. Uh, as far as I know, it’s ilegal to work for a company’s client if you’re on H1-B visa. Isn’t it only for direct employers?

  10. I had just been to India with my family and entered US via Chicago airport. Did not have this issue…Whatever has happened is bad according to me. USCIS had several opportunities to catch the employee or the employer before arriving at this decision right? Why did the officials not do their job then. They could have addressed this before approving the H1B or during the stamping. I know proper documents are provided to USCIS even when people work on the EVC model. Why would somebody have to go through this after traveling with their families for about 24 hours….They should keep them in the questioning area and then call the employer (contact details are being provided at several places) and let them answer this question. If they find some issues, take action against the company and close the company itself or penalize them.

  11. What does Employer-Employee relationship mean? I work for an Oil & Gas Engineering Training and Consulting company and they pay me on salary basis. I am on OPT and most of the time (Atleast 75% of the year), I work on in-house projects and trainings so, I will be working at my employer’s office. However, some times, I may have to visit our client’s office across the USA. Is my case okay? Thank you for answering!

    • Yes. I don’t think someone takes a cut of your salary. Also, I don’t believe you had paid “processing fees” to get your H1B, did you? If not, everything seems to be above board. Hopefully, you are paid market wages commensurate to your role, experience and qualifications, because that’s also part of the H1B rules.

      • Thanks for answering Dimparuti. I am being paid just above the market average for my experience level and my company will be sponsoring (paying the processing fees) for my H1B, next April. I understand your frustration and I am on the same boat too. What does Employer-Employee relationship precisely mean?

  12. sorry to hear about the case. But just to understand, we might work for employer and out petition is on the name of employer. But our LCA will have the address of our client / vendor. so in that case how can we go to employer location, we should be answering in that case because it is against the LCA rule right. I have seen they check address in LCA where the person is going to work.

    • ya, I am sorry to hear about that, but what I have also heard is that we can directly go to the client location, we should rather be going to that location only because this is what is mentioned in Client invite letter, LCA and Petition(WAL). so we should be having the answers to all the questions…
      but as they say.. at POE, Officer is everything so we can not exactly say what will happen…

  13. An obvious cheater got caught. No sympathy. Why don’t you admit that you had paid a so-called “consultancy” or rather, a pimp, to get your H1B visa illegally…..and continue to pay a share of your salary (30% or 20%). I hope more of you cheaters get caught and are kicked out, and barred from ever entering the US again. I had a full-time job with a Fortune 100 company after doing my Master’s in the US, and had to return because I didn’t get through the lottery – all because of frauds like you and the Indian IT bodyshops like Infy (another fraud which recently got penalized by USCIS) that clog up the system. Good riddance to bad rubbish, I say!

    • just FYI companies like PWC, Deloitte also take a fat cut from clients when you work through them

      • Big 4 firms get paid an hourly rate by clients and employees get salaries – there’s no revenue sharing involved. Obviously they can’t pay you what they earn through you. That’s how any business functions.

        Problem with the 80:20 split is that it’s misrepresented to the USCIS on what the employer-employee relationship is. Also, all of them charge the applicant for the visa – which is patently illegal in the first place. Finally, the employees are paid below market rate – the sole reason that this practice survives. Again, this is against the rules for an H1B. While people on consultancy rolls get paid $60,000 in CA, someone with PwC or Deloitte with similar qualifications will get $120k.

        • Whether it is Fortune 100 or Big 4 or Forbes 10 company…or 80:20 or 70:30 split …Its a Deal that u make with ur Employer before joining, Its solely your decision to go or not to go …As Long as you are playing by the rules, it is fine…Don’t Unnecessarily abuse certain race, nation or South asians, indians. To increase ir chances in lottery, u could have used ur talent better way & applied more than 1 petition & Its 100% lawful too!

          For that matter, majority of US economy & innovations is heavily dependent on people originated from South asia no matter they are US citizens or not.U should take note of the Restrcitvie measures in US immigration reforms, irrelevant Visa hikes, Agricultural restrictive measures US or Europe takes for their own welfare!

Considering the top-10 institution I graduated from, I don’t think the visa officer was under any illusion of me returning back without trying to get a job. While it’s useless to debate on hypothetical issues, the point is, I never lied during the application process. Ok, hero?

          • I don’t want to brag about any top universities or some diploma. A person came on F1, the intention is to study. FULL STOP. Then, after graduation, if you love to work in USA, you apply for H1B, again FULL STOP.

            Just get into line of 65,000 ppl for that year and wait for your TURN. Again.. FULL STOP.
            And, stop that non sense of paying for H1B, you , me or anyone in this discussion other than the person who posted this story knows if he paid or not. Employee is never supposed to pay the fees for H1B. It should be purely employer sponsored program. Thats true. And, nowhere the employee says he paid for H1B and nor does the employer say they took money from employee. Respective employee should report to USCIS if an employer asks for the fees. then, the employer will be under scrutiny….

            Once, the petition is approved for an employee through an employer and certified LCA from DOL, he/she has a legal document to be employed in USA. Again FULL STOP. Now, to enter port of entry, go get your visa stamped and answer genuine questions and pass. At port of entry, be sincere and have necessary documents. They will ask only those docs which are relevant and were base for your h1b to be approved. Chill out friends…

          • Just email any of these consultancies and see whether they sponsor your visa for free. And thanks for the obvious advice, although I will be waiting in the line of 20,000 for the Advanced Degree quota.

          • Yes. that did happen to the OP. he had all legal documents. If ( IF, if its actually IF ) he had mis represented his candidature or paid h1b fees and applied for a job which he is not eligible for, then i would agree with you.

            But, i don’t want to do wrong assumptions.

          • Come on Dimparuti :-). 20,000 yeah… make it 85,000 as MS folks have lottery chance among crowd of 65k too when 20k is full … You post your resume on indeed or dice / monster .. u will get calls from 20 consultancies and 5 fortune 500 companies…. out of these 20, i bet you at least 10-15 will sponsor h1b without asking you to pay. Other 5, will ask you pay or they will ask you sign agreement to pay the expenses if you quit later.. or your ratio will be less…

            My point is, there are consultancies who ask employees to pay for h1b which is defintely a bad practice and should be avoided. Other option they have is to reduce the salary to compensate this fees ( like how other fortune companies do ). Another point, you don’t have to assume that all consultants on h1b have paid their fees.

            Its disturbing for me to hear from many ppl the kind of frauds happening in this area…
            1. asking employees to pay fees
            2. proxy interviews
            3. employees being paid less salary and not getting noticed by DOL while the employers get a good billing rate.
            4. and, what not?

            With having good academic background and the fuss back in my home country about reservations etc…. the h1b/immigration loop holes are more disturbing too….

            I understand your concerns and they are valid. But, i do not want to just assume that all consultants are illegal.

          • Also, since you know a lot about the process, two questions:

            1. For April 1 application and Oct 1 start date, what’s the earliest LCA can be filed?
            2. Will previous year’s LCA be no longer considering visa app didn’t make it through the lottery?
            3. Multiple companies can file multiple petitions for the same candidate, right?

          • 1. From the beginning date of employment, (DOL) accepts the LCA application starting six months. So, it will be April 1. But, i have seen employers filing H1B on April 1, I assume they had LCA prior to that… which beats the 6 month criteria ( i would recommend to check with your Attorney )
            2. No ( as the wages change frequently. Its advised not to use. better to check with attorney )
            3. Yes ( but not from same company for different positions )

            My knowledge is limited to my experience and other’s feedback. Its good for you to check with attorney

          • Yup, I’m concerned about Point 1 as well. Got to see that the attorneys do this right.

          • LCA is a cake walk, unless a citizen/GC holder contends for that job. Your attorney will be quick on it. By mid March, you ensure that your attorney has all necessary documents from you and they are all ready to file. No last moment surprises.

            2. Secondly we have every right to work anywhere in the world, just have to deal with some ducking rules.

          • Its not just consultancies, even some small american companies ask for us to pay for h1b and greencard. There is nothing illegal about it. Its part of employee employment contract. I think its illegal as part of government to interfere with employer employee contracts. Who are they to put rules on how businesses hire or fire? Every employer has put his own money at risk when running a company and should have freedom to hire or fire whomever he wants at whatever rate it might be. All these politicians who put rules on businesses most of them have never started a business on their own and never has created a single job. Just because government puts a law making something illegal doesn’t mean it is good. There is a minimum wage of $7.25. It definitely sounds good. but does it really have a good effect. If a minimum wage of $7.25 means everybody in the country makes atleast $7.25 why not make it $100/hr? If a poor guy who doesn’t have much skills and doesn’t have a job and is starving and if an employer feels sympathy for him but pays him $5/hr cash are you saying he is a fraud because he is not paying $7.25? If you are angry because of your situation blame the government which keeps putting increasing restrictions on immigrant workers. You got a job after masters but didn’t visa. I had many interviews after masters, the employers were willing hire but didn’t want to get in to the hassle of h1b and greencard. What should I do now? I need to be employed by someone to stay in US. So naturally I would go to a consultancy.

Why didn’t I get another employer to do it? Well, I had no intention of leaving my job after just 1 year. Yes, I agree that immigration rules can be unfairly restrictive….but it’s still the law of the land.

        And my intelligence (and obvious lack of yours) has nothing to do with a lottery which doesn’t take into consideration qualifications or experience. Name-calling won’t change what you are – a fraud who is always afraid every time he re-enters the US.

        I have an offer to join another Fortune 100 firm in Oct 2014 as a full-time employee, and God willing I will get the visa this time. And yes, my salary will be considerably higher than the 80:20 split you make from Employer A via Vendor B via Client C. Stuff that where the sun doesn’t shine and then take it out and smoke it.

          1. few people stand in the line all the day and apply at the end of the day.
          2. few people get some letters signed from “so called political influenced people” and move ahead in the line…..

          • Fortunately (or unfortunately, depending on your POV), I was one of the people who stood in line all day. I was even in the rarer group of people who didn’t pay a bribe during address verification time (took me longer and a RTI threat before I got my passport).

            I’m not blaming everybody, just the frauds. As regards your second master’s, wouldn’t it have been easier to come back to India and try again for the H1B? Staying and studying in the US, even with scholarships, is not cheap.

    90% of H1Bs who are contractors or who are full time? As far as I know, these incidents are common in the contracting segment and I have never heard such incidents for full time employees.

      • @Dimparuti:disqus .. This is not a place to take your frustration out. You did MS from US doesn’t make you special. Eventually you are also an immigrant.
        I also did my MS from one of the top 10 universities in US and I was also in the same boat. I also had to work through some consultant company as contractor since no one sponsored H1Bs for fulltime position at that time. Thankfully I was hired full time later on.
        What happen to the poster is really sad and this should not be happening to anyone. Either they should deny the petition at approval time or during VISA stamping. Deporting someone with valid VISA is not acceptable, that too when they have travelled so far with family and kids.

        • No, I’m not special. Neither am I illegal. No one’s disputing the universal desire to live and work in the US, but there’s nothing wrong in advocating the right way to go about it. And criticizing those who don’t. While it’s unfortunate for the OP and his family to face such an issue (along with assorted costs), you can balance that with the fact that he may have earned a good pay for five years under false pretenses. Karma is a bitch!

          • Not all consultant companies take money from employees to sponsor H1B. What do you think IBM, Delloite etc do. They do consulting, in a larger scale with better proceess. I think you have a lot to learn. Not from books, but from the real world. Probably you just graduated.

          • Nope. 10 years of work experience in total. The “consultancies” we are discussing are not the consulting firms like MBB and Big 4.

          • This doesn’t happen with big companies as they have right/enough documentations to support employer/employee relationship ( Still, its vague to ask at port of entry ). Few of the consultants go to Canada / mexico to get their visa stamped. And, those few are sponsored from small consultancies where they operates as a few job consultancy and not an employer with right HR/career benefits and sometimes their balance sheet is not in order. Going often to canada/mexico for stamping rather than to your home country, is first alarm to the officers to be suspicious and will start asking questions.

            Better have all the documents in hand to avoid this kind of scrutiny!

          • I kinda agree :). And, i still don’t understand how its “illegal” for any h1b personnel if he has a valid H1B and working for the client for which LCA is approved?

        • The end doesn’t justify the means, as regards your action. If you paid to get your H1B, you committed fraud. Period.

          • The “consultant” company? No processing fees involved? Does it do anything other than process paychecks after taking its cut? If not, it’s a genuine company – no subterfuge involved.

          • Yeah! There are few consultancies who do ask for money. But, not all of them are in that mode of asking money and others do genuinely sponsor. The company might be running the paycheck only. But, still he is employee of that consultant company ( whether he paid or didn’t pay for h1b ).

  17. it was exactly the same with me when I returned in November. He said to my face that there is no employer employee relation other than the company running my paychecks. He questioned me for about 20 to 30 minutes and his voice made me dumb and silent. I cannot say to him that 90% of consultants work this way. I am the only odd one pulled out for questioning. I do not know why these officers are so particular on H-1’s and screw our lives who pay taxes and lead a regular life and let pass many illegal immigrants crossing the borders. I was lucky that day that he let me go in disagreement. We both agreed to disagree that I am in a grey area with employer employee relation. I am so scared to go out of country next time as I think he might have left some bad note on my profile. Chicago is a worst place for H-1 immigration. Why do they even care on employment when the stamping was given and when there are no bad remarks on an individual?
