H-1B Visa 2015 – Documentation Review

H1B Visa 2015 Filing Season starts April 1st 2014, Tuesday. By now I would assume all those H-1B filing candidates have got their LCA approved or at least filed the LCA (Labor Condition Application). The current LCA processing time is still a week. If your employer haven’t still filed your LCA, make sure the employer file your LCA today!

H1B 2015 – Documents Overview

I would like to mention the list of documents the employer needs to have while preparing your H-1B petition to be submitted to the USCIS. Most of the employer by this time would have already taken the necessary documents from you. But, cross check with the list I am providing here and make sure all the documents listed here are submitted to your employer, so you may avoid any cases of RFE (Request for Evidence)

Documentation from Beneficiary – If outside of U.S.

  • All Degree Certificates/Diplomas (not provisional certificates)
  • Transcripts (complete set for each diploma/degree) showing courses taken and marks received Prior work experience letters on company letterhead (should show dates of employment, position/title, detailed description of duties, and be signed and dated)
  • A copy of any certificates of postgraduate training, showing course content and duration
  • Copy of all marked pages of passport
  • Signed offer letter from US company with assignee’s signature
  • Copy of current resume
  • Detailed job description, including duties to be performed and required skill sets

Documentation from Beneficiary – If inside U.S. at time of filing

  • A copy of all non-blank passport pages, including copies of I-94 cards (make sure dates are legible)
  • Copy of All Prior I-797s (ex: H-1B Approval Notices)
  • Copy of 3 most recent pay stubs for current H-1B Employer
  • Copy of I-20 (front and Back) and EAD Card, for F-1 Visa Holders Only
  • Copy of IAP – 66 (front and back), for J Visa Holders Only
  • Social Security card
  • All Degree Certificates/Diplomas (not provisional certificates)
  • Transcripts (complete set for each diploma/degree) showing courses taken and marks received
  • License or other authorization to practice the profession (if applicable)
  • Prior work experience letters on company letterhead (should show dates of employment, position/title, detailed description of duties, and be signed and dated)
  • A copy of any certificates of postgraduate training, showing course content and duration
  • Academic credential evaluation – For non U.S. degrees only (if none, we can obtain for you)
  • Offer letter from Petitioning Employer
