A very good news for H4 spouses who are waiting for the EAD Updates. The step 7 (Preparation of Final Rule, Interim Final Rule or Direct Final Rule) of the H4 EAD rule making process is Complete and the final rule is submitted to OMB for review and approval.
What is H4 EAD Rule?
Under existing regulations H4 dependents cannot work in the U.S . This proposed rule will amend existing regulations to allow H-4 dependent spouses of certain H-1B workers to request employment authorization.
Who are Eligible?
Eligible individuals would include H-4 dependent spouses of principal H-1B workers who:
- Are the beneficiaries of an approved Form I-140, Immigrant Petition for Alien Worker; or
- Have been granted an extension of their authorized period of stay in the United States under AC21 . AC21 permits H-1B workers seeking lawful permanent residence to work and remain in the United States beyond the six-year limit.

Current Status – What`s next?
It will take 30 to 60 days to complete the review and it will be submitted for publication. Publication of the final rule is the last step of the process.

Hi, I have transferred my visa from H4 to H1B and I have received work permit from Oct 2014. I have obtained SSN but I have not joined any job till today. I didnt go to India for Visa Stamping so far. My husband who is H1b visa holder has approved I-140. Shall I revert my h1b visa to h4 back and apply for H4 EAD?
I didn’t understand the point 2 in the eligibility criteria “stay in the United States under AC21 beyond 6 years”. I was in L1B for 5 years, then I transfer my Visa to h1B and I have been on H1B for last 1.5 year, and my employer applied for GC in 2012 and it pending with USCIS since then (due to denail and appeal). So does my spouse eligible to work under this rule? Since I am in US beyond 6 years limit?

I have a question. I am on an H1B for 2 years and my I-140 is approved. Would my spouse get EAD. or is the 6 years stay mandatory?

What is the source of this update ? There is no update on USCIS site or the rule itself that something significant was completed on 02/05/2015.
I dint understand the eligibility criteria “Are the beneficiaries of an approved Form I-140, Immigrant Petition for Alien Worker.” If some one can help me understand. I am in US on H1 for past 3 months. So will my spouse be eligible to work on H4, once the final rule is approved.
No. Only once you start your Green Card process, you will have your PERM and then I-140 approved. Once your I-140 is approved, your spouse can work.
I have a question regarding EAD:
if a person is working in company A, with I-140 approved. if he change his job from company A to B, does his/her spouse is eligible for H4-EAD? or he needs to complete I-140 in new company?
From what I understand I-140 is tied to the petitioner. It does not matter from which company it is approved.
What do u mean? i think your statement is conflicting.
Lets say person has approved I140 from company A (petitioner) and he moves to company B (new petitioner). does he has to get I140 approval from company B to apply for H4-EAD?
I am in the same boat here, if I move to a different company, not sure if I need to wait until my I-140 is approved with the new company to apply/continue with H4-EAD
