Good News for STEM OPT students! The STEM OPT extension will be in the place until May 10 according to the current court order. Hooray!!! This will give DHS enough time to propose/publish the rule and get it enacted.
The STEM OPT extension program gives the rights of spending an extra 17 months to the students studying science, mathematics, technology and engineering. These extra 17 months are for working in the US on top of the 12 months which are accessible to international students, was previously meant to expire on February 12th due to a court litigation. It is done after the federal judge marked the registration invalid.
On Saturday, in a decision, it is said by that the ruling must be stayed for 90 more days in order to give time to the Department of Homeland Security to implement the new rule. The rule is meant to inhibit disruption or adversity for participating employers or students.
Judge Huvelle said that the importance of the disruption cannot be exaggerated.
DHS says, “The significance of that hardship cannot be overstated. According to DHS, there are approximately 23,000 STEM OPT participants; 2,300 dependents of STEM OPT participants; 8,000 pending applications for STEM OPT extensions; and 434,000 foreign students who might be eligible to apply for STEM OPT authorizations."
Many of the people would have ben affected badly if the stay was not extended. The effect would be so adverse that these people may lose their current work authorization i.e. inability to apply for OPT extension or maybe there is no benefit of this extension to such people in the future.
With the deadline extended, DHS will have ample amount of time to publish the rule and get it enacted soon.
