Hi, My spouse traveled to INIDA from USA a day before (‪25-June‬) my organization submitted the extension application to USICS (‪26-June‬) due to this My spouse''s extension application status has been update as NOID. I got anupdated that my family can travel after my spouse extension application has been withdrawn and given explanation for NOID. Now we got our visa stamped and planing to travel in 3 days. Will this impact my family''s entry to USA.

My situation:

1. I have approved I140 from Company A
2. Applied for H4 EAD (applied today so it will be in process for atleast a month if not more)
3. Received offer from Company B

Questions
1. What would happen to H4 EAD application if I join Company B and Company A revokes my I140? Will it get denied for the reason I do not have approved I140 although when I applied for EAD my I140 was valid?
2. What would happen to H4 EAD application if I join Company B and Company A does not revoke my I140?

I really want to accept the offer from Company B but not sure what would happen to the EAD application, any help is really appreciated! Thanks!

Hi Team,

I am filling question 18(H4 EAD Application form) and It is asking to provide the Receipt number of principal H1B spouse most recent 797 notice of approval for I129.

1. I had I-797 approved form with out the Alien Registration number(A-Number)

2. I had approved I140 with Alien Registration number(A Number)

Do I need to provide the I140 Receipt number or I-797 Receipt number?

My husband's H1B will get expired the end of 2016, we have not apply the extension of H1B yet. If I apply for H4 EAD, will the new EAD get expired at the end of 2016 also? If that is the case, I probably need to apply extension right after I get the EAD then pay the $380 again soon. Should I apply the extension of H1B first then?

Hi,

Please find the details of my case in details.

I came to US in July 2014 on H-4 with my husband. My husband's visa was due to expire in September 2014.
He applied for extension and got extension till Sep 2017.

Current i-94 and i-797 are valid till Sep, 2017.

I applied for H1-b Visa this year in April. My case got selected in lottery and got approved as well.
As per my information, I will be on H-4 till 30th of September.

My husband has to switch his job at this time. I am wondering if there is going to be any risk to my approved H-1b Petition due to this transfer.

I have three questions.

1. If my husband goes for a Visa transfer there is a possibility that my H-4 also gets transferred along with his H1-b.
I have read somewhere that USCIS will consider the visa that is approved in the last. My H1-b was approved in June 2015 and in case i have to transfer the H-4 along with my husband's H1-b then my H-4 will be the visa that is approved in the end, Will this pose any threat to my approved H1-b.

2. If there is no issues to my H-4 status till 30th of September will there be any issue if my husband's Visa gets an approval after 1st of October as he can't file in premium due to suspension of premium processing by USCIS.

Note: My husband's current employer will withdraw the petition as soon as my husband resigns from this company to join the new one..

3. If I don't get my H-4 transferred along with my husband's. If this is the case then will my visa status be legal till 1st of October?

Hi,

I have submitted my DS-160 for my H4 visa and also paid the fees. I am planning to appear for the H4 visa interview at US Consulate, Chennai ( in Feb 2015)

Now my Husband (H1B visa holder) is promoted and his Title and Salary is changed. He is also moving to a new residential address in California.

I am planning on changing my status from H1 to H4. My husband will be changing to a new company in the next couple of months. We both live in different states.

I have couple of questions.

1. Is it better to file my COS along with my husband's H1 transfer?

My husband's employeer filed GC in EB2 on May 2014. Priority date is May 10 2014. I have 2 questions. will be thankful if anyone knows and replies

My wife is on H4 so she doesnt have a photo id(DL, StateID).

Visa is going to expire in May 2014.

She has to take her passport with her as a ID proof. We have a valid visa till May 2014. Extension is filed. Status is pending.

An employer is willing to file my H1 for the 2015 cap but due to unavoidable circumstances I need to return to India. this means that my h1B petition will be filed when I am in India. Hi, I am working in USA on H1B visa and my wife is here with me on H4. Our I-94 expires on Sep 29, 2014. She wants to start working here and put her resume on some of the Employment Sites. My wife recently went through the H4 visa interview and she was approved. During the visa interview process, she had to submit my original I 797 form and her passport. This was at Delhi Consulate

Is it normal for the visa consulate office to take the original i797 form during the h4 interview? Is this something new?

I'm hoping that they send the original back with her passport because I would need that during my re entry into United States along with my h1 b stamp.
