H-1B Visa Stamping – Confidential Employer`s Documents

The Visa Officer at the U.S. Consulate may ask the candidate to provide the following sensitive and confidential documents

  • Employer’s last two years tax returns and financial statements
  • Notarized list of all employees of the petitioner.
  • Petitioner`s State unemployment wage reports. This report should show all wages paid to each employee in the state, for the past three quarters.

The above documents are accessible to the employees if the company is publicly owned. Some privately owned companies and small–scale companies do not prefer to give these confidential documents to the employees for security reasons.

What if the VO officer asks for these documents and you don’t have them?

It is always better to be well prepared to have an answer ready if the VO asks for the documents which were not provided to you by the employer. Do not panic! Explain to the VO officer that these sensitive documents are not handed to the employees due to security reasons.

It would be advisable to have your employer provide you a letter of reference describing the scenario at the company and mention why few documents cannot be submitted by the employee to the consulate.

The letter from the employer would basically explain that some documents requested by the consulate cannot be provided to the employee because of the company’s rules or security reasons. The letter should also include the details of the person to contact by the consulate if they have any further queries. This letter would let you be on a safer side.

    Firstly ask your Employer if they could provide you with a copy of their tax documents and if they cannot do so ask them to provide a letter giving your employer’s contact details and explaining why they cannot provide the document.     And in either way if you receive a 221G, your employer could submit the documents online to the VFS. All the necessary details would be on the 221G form.

  2. My employer asked me how can they submit the tax documents to USCIS if i receive 221g. Can they submit it online ot by mail?

    Many of my friends told me that this document is necessary for the h1b interview. Is there any possibility of rejecting my visa due to lack of this document?

    I`m really confused and i dont want to go to india coz i`m scared.
