H-1B FISCAL YEAR 2015 CAP REACHED

The H-1B Cap for Fiscal Year 2015 has been reached as per USCIS Announcement. As expected lottery would be held very soon. It is yet not revealed on how many petitions USCIS has received under general and masters quota.

U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2015.  USCIS has also received more than the limit of 20,000 H-1B petitions filed under the U. S. advanced degree exemption.

Before running a random selection process, USCIS will complete initial intake for all filings received during the filing period which ended today. Due to the high number of petitions, USCIS is not yet able to announce the date on which it will conduct the random selection process.

Lottery Process Ahead

A computer-generated process will randomly select the number of petitions needed to meet the caps of 65,000 visas for the general category and 20,000 under the advanced degree exemption. USCIS will reject and return filing fees for all cap-subject petitions that are not selected, unless found to be a duplicate filing.

The agency will conduct the selection process for the advanced degree exemption first. All advanced degree petitions not selected will become part of the random selection process for the 65,000 limit.

USCIS will continue to accept and process petitions that are otherwise exempt from the cap. Petitions filed on behalf of current H-1B workers who have been counted previously against the cap will not be counted towards the congressionally mandated FY 2015 H-1B cap. USCIS will continue to accept and process petitions filed to:

  • Extend the amount of time a current H-1B worker may remain in the United States;
  • Change the terms of employment for current H-1B workers;
  • Allow current H-1B workers to change employers; and
  • Allow current H-1B workers to work concurrently in a second H-1B position.

    I have a fairly decent publication record with large number of citations. I also have done some reviewing work for scientific journals. My employer has filed for H1B under Advanced Degree Professionals this year. Do you think I can request my employer to file for O-1 if my H1B doesn’t go through the lottery? Has anyone done this successfully?

  7. i dont get the paranoia of some people not believing their companies have filed their H1. if you cant even trust your company in doing that..then your at the wrong place or your working for a fake desi consultancy with fake resume and added experience when you have maybe 1 yr of true experience.

    My employer has confirmed that petition has been filed for FY 15. Is there any document or receipt number that indicates the petition has been filed (Before Lottery). Am bit concerned, What if my employer doesn’t file and says that it has not been selected in lottery. Any document to verify this ??

    • You should get a receipt number from your immigration attorneys (or employer) regardless of whether the petition has been selected in the lottery. I haven’t received mine yet, either, so maybe the people at USCIS aren’t quite done processing the incoming mail yet. But you should get the number any day now.

      • Thanks for the reply. But what i heard is that there wont be any receipt number generated until the package is selected in lottery (Which is nothing but, I 797 -C). If it is not selected then the package will be returned as is.

        In case, my assumption is wrong, Is it possible to track or any update based upon the receipt number which you have mentioned??

    • I don’t get this… if you have been hired why would the company do that to you? are you based in India and applying through an agent??

  9. Guys, I need your help, i have filed two applications y two different employers. What will happen
    1) If both get selected?
    2) One Selected and other did not

    Will i get the filing charge back if i get one application and other did not select? Will i get the filling charge back for second if both selected and i chose the first one?
    Will i ever get the filing charge back if nothing selected?

    • 1) If both get selected, you can select either one. And you will not get any refund back
      2) You will get the refund for the one that is not selected
      3) You will get both refund back when nothing is selected

      Note: Learnt from experience. Not an attorney.

    • I do not know why you accept offer from both employeers. You should be serious on one of them

    • I have read that they will reject, if they find out that you have filed ur H1B through 2 different employer.

      • dats not correct…U can have multiple petitions from different employers,but cannot have from same employer.

    • You can apply from multiple employer, if both get selected, you have to choose with which employer you want to work, in that case your filling charge will not get it back of another application which you are not chosen. If nothing selected you will get the filing charge back.

  11. Hi Guys, In case if i didn’t get H1B then after completion of my 2yrs OPT, is it possible to get CPT? (In case if i join in new degree/course). If i get CPT then how may hours can i work as a full time employee?

  13. My application reached today in the morning because of the UPS delay . Is it ok or Is the H1B 2015 application receiving process also closed? In addition, because of the delay and to be on the safe side my lawyer filed two applications so at least one reaches on time. Now both have reached. Will both be rejected? or just one?
