H1B Visa Transfer – Changing Employers

H-1B transfer is the process of having a new employer sponsoring for your H-1B visa so that you could work for that employer. An employer can petition for an H-1B transfer to the USCIS on behalf of a candidate any time in the year and this is not subject to any quota. A candidate can transfer and start working for the new employer once the H-1B transfer has been approved by the USCIS.

H-1B Transfer Process:

  • New Employer files I-129 petition with the USCIS requesting for the H-1B transfer process.
  • USCIS processes your case and a decision is made.
  • If USCIS approves the H-1B transfer, your present employer needs to be notified. Note that there is no necessity of getting a no objection certificate from the previous employer for the H-1B transfer.
  • You can join and start working for the new employer any time after USCIS approves the H-1B transfer and you could work until the H-1B visa expiration date (as per your LCA).

H-1B Transfer Processing Time:

You could choose to apply for an H-1B visa transfer through regular processing or premium processing.

  • H-1B Transfer – Regular Processing generally takes from one to four months to have a decision made.
  • H-1B Transfer – Premium Processing would take around 15 to 30 days.

H-1B Transfer Fees:

The fee is the same as your initial H-1B Filing and has to be paid by your employer who is doing the transfer. The following is the fee structure.

I-129 Fee: $325

American Competitiveness and Workforce Improvement Act of 1998 (ACWIA) Fee: If 25 employees or more, then $1500; If Less than 25 employees, then $750

Fraud Prevention Fee: $500

Public Law 111-230 fee: According to this law, If the company has more than 50% H1B employees then they have to pay $2000

Premium Processing Fee: $1225

Fee for Different Scenarios:

Scenario 1: Small company (less than 25 employees)

Total Fee: $325 + $750 + $500 + Attorney Fees =  $1575 + Attorney Fees

If the employer wants to do it in premium processing, then add $1225 = $2800 + Attorney Fees

Scenario 2: Large company (More than 25 employees)

Total Fee:  $325 + $1500 + $500 + Attorney Fees =  $2325 + Attorney Fees

If the employer wants to do it in premium processing, then add $1225 = $3550 + Attorney Fees

Some Noteworthy Points:

  • While filing for an H-1B transfer with a new employer, the current employer doesn’t need to be notified. Approval from the current employer is not necessary to file an H-1B transfer.
  • There is no limit on the number of times an H-1B transfer can be applied.
  • H-1B transfer can be applied for multiple employers at the same time.
  • There is no necessity for H-1B visa stamping if you are still having H-1B stamp unexpired, for an H-1B transfer.
  • Although your H-1B transfer has been approved by USCIS, if you change your mind you could still continue working with the present employer as if the transfer was never filed.
  • If you are on H-1B and are in your home country and want to transfer your H-1B, there is no requirement to show any documentation related to the prior legal status in the U.S.A.
  • If you are on H-1B and living in the U.S.A., recent pay stubs, bank statements and w-2s are the documents necessary to be submitted in order to prove your current legal status of your H-1B transfer. In case of filing a transfer before your H-1B period starts (October 1st), you do not need to have any pay stubs submitted to the USCIS.

  1. I have my stamped h1B, which got expired recently and my company has filed my extension in subject to non cap category. I have travelled once on this Visa. Can my visa be transferred to company B in US while me being here in India?

Hello, Previously i worked for employer A (i94 /H1B valid till 08/2018 after extension) and now i started working with employer B with the receipt notice (transfer approval is still pending – Non Premium Processing). Now i got a better position with employer C and want to transfer my visa with them and work for them.

    Is it possible for employer C to file a H1B transfer petition for me without getting the approval applied by employer B?

    I got my H1B petition approved from Company A and after approval there is no H1 requirement in company A .So I transferred my petition to company B and it is approved now.

    Now company A has onshore requirement and they are processing my petition for stamping. is there any chance my company A know that I transferred to company B and any problem in visa stamping for company A. I am interested to work with company A. Please advise.

I have 2 pay checks run from my new employer. In this scenario can i go back to my previous company and join him back.     1-I was wondering if you could advice me for my situation. I have my H1B from company A and started process of transferring H1B to Company B, got LCA approval and the rest is under processing. While I am still in the process of transferring H1B visa from company A to B, can I transfer my H1B to company C ? The reason I am asking is, I just recently started the transfer process from Company A to B and I know I had to provide my last approved H1B for the transfer process. And now if I want to apply for company C I do not have my company B H1B approval so what should I do if I was asked to provide the last approved H1B for company C?
    2- If my current H1B transfer gets denied and I appeal or, can I transfer to Company C while it is under appealing ?

    till i get an approval, Is this allowed to travel India ? Or is there any restriction like cannot be travelled since waiting for H1 transfer approval.

    Working for Company A, got offered from Company B and visa is also transferred.
    Company B called just before a week to join and said the offered position is closed and so i may have to wait until a update on my next work details.

    Plans of about to put paper to Company A is kept on hold from my end and Company A is not aware of this.

    Q 1: What if i have put paper with Company A and then Company B says like this ?
    Q 2: Until what time frame i can join Company B as my visa is transferred to them.

    I am in tough situation. My visa was expired on sep30th 2014. And my company started processing LCA & extension. Yesterday (Dec 3th 2014) i got the approval from USCIS saying that “On December 3, 2014, we approved your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number ###. We will mail your approval notice. Please follow the instructions in the notice. If you do not receive your approval notice by January 2, 2015, please go to http://www.uscis.gov/e-request to request a copy of the notice.”

    And my company booked my return to india tickets for this sunday (Dec 7th).

    I am planning to resign from my current company to stay back in US. Is it possible to stay back in us with out petition. because currently they have not mailed my petition. And is there any chance to revoke my petition for my current employer?

    Please suggest the possibilities to stay back in us & suggest me is it better way to resign or not?

    I have my H1B approved since 1 month ago, my sponsor, employer A, is asking me to wait for two or three months until they assign me a project. I might have other opportunity with other employer B, can I ask for the transfer when I had never worked for employer A.

  21. 1. In April a consultancy in US sponsored my H1B visa and filed a petition with USCIS. In the petition, the consultancy selected consular processing option as I was in India that time.

    2. In July the petition got approved.

    3. In October, my wife got relocated to US(she is on H1B visa) and I came along with her on H4 visa.

    4. The consultancy which sponsored my H1B visa does not have any project for me currently and is not interested in filing for Change Of Status(H4 to H1B) in the near future.

    5. Consultancy has told me to find another employer and get H1B transferred.

    My doubt –

    If any employer/consultancy offers me a job & files for H1B transfer, then would I be required to go back to India and get the H1B visa stamped?
    OR
    Can the new employer file for H1B transfer & Change Of Status simultaneously such that my status automatically gets changed to H1B once the H1B transfer is approved?

    I am currently in Usa and my petition is valid till 2015. I just stayed in USA for a year. Due to some family reasons I need to go back to India.

    1. Is it possible for any employer in India to transfer visa in India. I can travel back after one or two years.

    2. As my petition expires in sep 2015 , if I did not travel till that time from the new employer. Will the visa be ended. Or usually companies file extension for that.

    3. Do I need to contact consultants or employer take care of all this during interviews.

    I work for Company A and they Filed H1B for me. Its approved. I have the soft copy of approved H1B petition. Hard copy is with company. Stamping is not yet done, so not entered in US yet.
    I got offer from Company B they are ready to transfer H1B.
    Questions –
    1. Can my H1B petition be transferred?
    2. Will it come under CAP limit?
    3. Company B says they will initiate transfer only after I will join them. If I resign from company A, can Company A revoke my H1B petition?
    4. If yes, even after company A revoke my petition, can Company B file new petition or transfer old one? Will that be in CAP limit?

    Any other suggestion….

    Although, mine is a little peculiar case:
    I had come to US in 2013 on H1 (until 2015) with a big employer and during this time (i.e from 24th Jan 2014), I had another employer, say e1, who applied for my transfer. I quit my big employer on Feb 4th but didn’t get any job yet and my visa transfer was still in progress.
    I got a job with another employer e2 and they applied for my transfer from my first big employer and I received a transfer receipt (EAC number on 22nd Feb) and e2 has started my payroll from that day.
    Basically my question is, since I had a gap of almost 20 days during which I had no payroll running and no status (I am not sure of this) as my transfer by e2 was from big employe and not from employer e1, would it be a problem for me during visa transfer or anytime in future.

    Please let me know if any details are unclear, I hope and pray you give me a quick response. Thank you.

    My H1B got approved for the client x for the year 2013 and I am waiting for the PA date. I am still in india. my current project dont have onsite oppurtunity for me. I checked with few more project in my company but they said I cannot travel to all the location because I got promotion recently. they are not filing the LCA for the location which I am not eligible for. there are no projects in the list of locations my company gave and I dont know what to do with H1b. my question is..

    can I apply for some other company in india and move to US with the same H1b?

    is it possible to travel for the same project I work ( I have another oppurtunity as well) and get transferred from that location to some other location ( even the location which I am not eligible to travel with promotion ) ?

  40. i am currently at the end of my 6 year visa period. It expires on May-2013. My GC is currently under processing with my current employer and is at i140 stage. Once my i140 is approved i can apply for 3 year extension. But i got an offer from another employer who is willing to transfer my visa. My labor is cleared. So, if I transfer my visa to another employer, will my petition be approved only till may 2013 or since my labor is cleared with my current employer, can the new employer file it for 1 year using the current employer’s labor.     • Yes. You can transfer to a new employer if you have the proof of prior approval (i-797) even though you didn`t enter U.S.

    • You don`t have to wait till your H1 start date(Oct 1st) or H1 stamping. You can apply for H1B transfer after your H1B approval.

      There shouldn’t be any problem as it is not mandatory to inform the current employer about your H1 transfer.
