Employment Authorization for Certain H-4 Dependent Spouses has been a topic of discussion at the Senate for years. The Federal Rule Making Agenda mentions the proposed rule for H-4 EAD would complete by January 2014. This would allow many spouses living in the united states to start working and have their dreams fulfilled.

The Department of Homeland Security (DHS) proposes to amend its regulations by extending the availability of employment authorization to certain H-4 dependent spouses of principal H-1B nonimmigrants who have begun the process of seeking lawful permanent resident status through employment. Allowing the eligible class of H-4 dependent spouses to work encourages professionals with high demand skills to remain in the country and help spur the innovation and growth of U.S. companies

It looks like we are close to finishing the first step by the end of January 2014.
It is very real. Just want t update that it is 1 or the other. ie. either more than 6yrs and applied for green card awaiting labor or I-140 processing or I-140 approval. So in the case where you have I-140 approved but have not finished 6yrs your spouse can still apply for an EAD. We are still in early stages of this, based on the other post step 5 out of 9 in the rule making process
I am a H4 visa holder . my husband is on H1B but he just completed 3 years on it and his university where he is working filed his green card. am i allowed to work? as by profession i am a civil engineer and even completed my M Tech in “Environmental “.

Should the principal holder be completing 6 years of stay in US ? Will this hold good in the cases which the principal holder who did not use his H1 for 5 years 11 months ( with in the validity period of 6 years) and then extends his H1 ? As the rule says “and have extended their admission or stay” .. So should an extension suffice or is 6 years mandatory ?

The principal holders should have completed 6yrs of stay in H1B + green card should be in process for H4 to get eligibility for EAD.

If yes then at what level they will allow H-4 to work?
Yes, it is only for spouses of those persons who have already started their green-card process and have cleared the Labor . It is NOT for the spouses of just any regular H1-B holder.
