I-140 EAD / Job Portability on Cards? – Proposal Submitted

The Department of Homeland Security(DHS) submitted a proposal to modify some of the regulations for employment based immigrant workers under the title “Retention of EB-1, EB-2, and EB-3 Immigrant Workers and Program Improvements Affecting Highly-Skilled H-1B Alien Workers” to Office of Management and Budget(OMB) on 19 Nov, 2015.

This is just a proposal submitted by the USCIS to OMB for its approval and we can expect it to get published in the federal registry by December, 2015. The contents of the proposed rule is not available yet. But, We can expect some good news regarding the following topics.

  • AC21 Rule – Job Portability for i-140 approved applicants
  • EADs for certain 1-140 approved applicants

The proposed rule says, to change regulations such that to provide stability and job flexibility to immigrant workers while they wait to become lawful permanent residents in US. At this time, just the abstract of the proposed rule is available and we will keep you update on this rule.

  7. Well done– to those seeking to recognize the talent , skills, education and legal status of highly skilled H-1 immigrant workers and entrepreneurs. For their huge monetary contribution the American economy, they do merit a permanent resident status \ citizenship in the country.
