H-1B 2015 LCA – Have your Employer Filed Yet?

USCIS would start accepting H-1B Visa 2015 Petitions from April 1st 2014. Are you planning to file H-1B Visa for this year? It is very important for you to check with your employer if the employer is all set to file your H-1B petition starting April 1st, 2014, keeping in mind a possibility of H-1B lottery for this year. Make sure your employer has filed your Labor Condition Application and got it certified.

Did your Employer File LCA?

A certified Labor Condition Application (LCA) must be submitted in order to file your H-1B petition to the USCIS. An LCA is filed with the Department of Labor (DOL). An online system has been developed by the DOL for this purpose.  The online system would automatically determine if the submitted LCA is certified or denied depending on the information provided by the employer.

If your employer haven’t filed an LCA yet, make sure your employer files it right away. You may ask your employer to provide you the certified LCA copy for your records (if already certified) or case number (if LCA filed) in order to check the status of your LCA.

Labor Condition Application status can be checked at https://icert.doleta.gov/. Your case number would be of the format G-100-12345-123456. On the page on the right hand side, you would find a status check box to check your LCA status.

LCA Processing Time

According to DOL, H-1B LCA would take up to seven business days. DOL mentions that the current processing time is still around seven days.

  2. Is there are a possibility that already filed/certified LCA can be used to file the H! for a person now. Like LCA case whihch was given by the empoyer as a proof seem to have been certified on 3/11, however we approached the employer and gave all documents on 3/17.
