A bipartisan group of senators are planning to introduce a new high-skilled immigration bill next week, which would make a huge difference to those non-immigrants who would want to work in the United States under H-1B visa category.
This skilled immigration bill not only proposes to increase the base H-1B visa cap to 115,000 visas, but also allows raising the cap with demand to a maximum of 300,000 visas annually.
Current Scenario on H-1B’s
Currently, the U.S. holds an H-1B cap of 65,000 annually. Another 20,000 H-1B visas are set aside for those advanced degree graduates from U.S. universities.
What the Bill proposes?
The new immigration bill proposed would increase the H-1B visa cap from 65,000 to 115,000. Once the H-1B cap reaches 115,000, the cap is increased automatically as per demand. It would also create the so called “Market-based H-1B Escalator”, which would adjust up or down depending on the demands of the market. The cap can at most reach to 300,000 each year, depending on the market demand.
Immigration Innovation Act
The above bill is likely to be introduced early next week, on Tuesday. Sens. Orrin Hatch (R-Utah) and Marco Rubio (R-Fla.) are co-sponsoring the bill along with the democrats Chris Coons (D-Del.) and Amy Klobuchar (D-Minn.). This immigration bill named Immigration Innovation Act, would definitely earn high support from the tech industry.
This bill would be a great advantage to those foreign-born workers dreaming to land in the United States and work at the U.S. Lets wait and see what happens to the fate of this bill in the coming week.

How about allowing H4B visa holders (with technical skills) to also get the permission to work in US?
according to the new law, H4 visa will be given EAD valid in conjunction with the H1B spouse. Good news indeed!
