Travel out of United States – OPT / CAP-GAP SCENARIOS

This is the time during which most of the F-1 visa holders who applied for H-1B would be entering into cap-gap extension period, due to the fact that their F-1 visa status and work authorization have or will be expired.  CAP-GAP is said to be the period between the time when an F-1 student’s visa status and work authorization expire in a particular year, and until September 30th of the same year, when the candidate have filed for an H-1B visa in the current fiscal year.

There are questions among most of the F-1 visa holders applied for change of status from OPT to H-1B and having travel plans prior to October 1st. I would like to address in this post different scenarios and how possibly it would affect their immigration status in the United States  if traveled out of United States.

TRAVEL OUT OF UNITED STATES ON OPT AND H-1B DECISION PENDING?

H1BWiki Suggests not to!

When a candidate would travel during H1-B change of status decision pending, it is considered as an Abandonment. You can return back to the United States but you may need to file COS (Change Of Status) again or enter the United States after getting your H-1B stamped.

TRAVEL OUT OF UNITED STATES ON CAP-GAP?

The Answer is NO.

According to the USCIS,

A student granted a cap-gap extension who elects to travel outside the United States during the cap-gap extension period will not be able to return in F-1 status.  The student will need to apply for an H-1B visa at a consular post abroad prior to returning.  As the H-1B petition is for an October 1, 2013 start date, the student should be prepared to adjust his or her travel plans, accordingly.

You might be stopped at the Immigration and sent back if you may leave before October 1st 2013, with the scenario described.

TRAVEL OUT OF UNITED STATES ON OPT AND APPROVED H-1B ?

The Answer is You May, Under Specific Conditions!

If your H-1B is Approved and you still have your OPT unexpired with a valid EAD card, you may travel out of United States. It is important that you have to return back to the United States before your OPT gets expired. In this scenario, you may continue to work on H-1B from October 1st.

Please consult your immigration attorney if you wish to travel out of the United States and you are in the current scenario. You may want to check if CAP-GAP applied for if your OPT expires before October 1st 2013.

The above three scenarios described are the most common scenarios for those who would like to travel out of the United States prior to October 1st, while H-1B approval pending or approved. Travelling out of United States while you apply for change of status is RISKY. I would recommend you to consult an immigration attorney if you have any plans of travel. I would also suggest you to change your travel plans so you may leave after October 1st, after you enter into your H-1B Visa Period.

I returned to India in this summer vocation in June and came to know that my H1b got approved which is valid from oct’1st, after my return to india. Now is that safe to return to US on same F1 visa without any problem at port authority since I got valid i20 and f1 visa

    I'm currently on OPT. My OPT Extension starts from May 10 , and my H1 is inititated. I'm planning to travel to India for my sisters marraige. My travel date is JUL 22 2016 to AUG 23 2016. Can i travel if my H1 is picked?? As i know that even if H1 is picked it starts from OCT 1st only. So could anyone suugest me can i travel in OPT extension when my H1 is filed and picked…

     

  3. I’m currently on F-1 visa and my visa is still valid until December 2015. I submitted H-1B petition with starting date on October 1. Can I travel back to my home country during the summer? I will return in August to conduct my last semester.
    If my H-1B petition got approved before my returning, obviously I would need to apply for H-1B visa in my home country. Can I still come back in August for my study?

    I am on OPT extension period right now and my H1B is already approved but my Wife’s H4 is still pending and not been approved. My wife wants to travel to India in 1st week of august and come back in 1st week of September before October 1st 2013. Also My Opt extension ends on September 27th 2013 and Cap-Gap Kicks in for 3 days.
    Could she travel to India and come back within this period? Also does she need to go for Visa Stamping?

  8. I have my H1B approved and will start October 1, 2013. My OPT expired on may 10, 2013 and I am in the cap-gap extension period. I would want to go to India in November to get my H1B stamped. Is there an issue in that scenario? I have heard if you fly through UK, you need a transit visa because you dont have any valid US Visa during your travel. Appreciate your help.

    • Yes, very safe indeed. I did in January and I was on extended OPT. They just verified my I-20’s (all of them).

      • Imteresting. So what if I don’t have a F-1 stamp in my passport? is the visa interview too tricky? I know that there is a small risk.

  13. What happens if my OPT starts from 1st June 2013 and I left the US for a 3 month trip to India on 1st April 2013. My company has applied for H1B on my behalf but the results are not out for me yet. Will I be able to reenter the US on 1st July 2013? The 2 sub-cases are:
    1. My H1B gets approved
    2. My H1B does not get approved

    • Not recommended… Why you want to take such a risk? wait until October, no?

      • Some family emergency made the trip unavoidable. When you say “Not recommended”, what are the specific legal issues that can arise if my H1B gets/doesn’t get approved?

        • I do not understand your scenario here… U don’t have OPT yet (I guess first OPT not extension) u already have a job (?) on what status? your company applied for H1 already (?) this is only April so u must not have even graduated(?)

          All you need when u hit the port of entry is proof of legal status. For students it is I-20, for OPT students I-20 with employers name and duration of OPT, for extended OPT candidate all previous I-20’s with latest I-20 showing current employer and duration. In some cases they ask for OPT card (mostly they ask only I-20). when returning on H1 u need u r stamped H1 visa… that can happen only after October (I don’t know if u can appear for H1 visa interview in June (In u r case)) …

  14. What if my H1b visa has started but it has not been stamped and I still have my OPT valid. Can I travel outside the US and come back on OPT.

    • You can according to LAW, a CBO office may question your intention of change intention from Non immigrant Student to a Temporary worker, Talk to your employer or Attorney

    • NO, you cannot come back on OPT! Once you H1B Visa has started, that means your OPT is not valid anymore!
