Two People Arrested In H-1B Visa Fraud

H1B Wiki has published many articles on different scams/frauds where fraudsters targeted H-1B employees. Here, we are bringing up one more H-1B Visa Fraud to notify our viewers and to create awareness about different scams/frauds that are happening around us.

Two Indian- Americans, residents of Jersey City, were arrested today in New Jersey on charges of H-1B Visa fraud.

Hiral Patel, 32 and Shikha Mohta, 31, employees of SCM Data Inc and MMC Systems Inc have been charged for bringing in foreign workers with  false IT Experience and to obstruct justice.

According to Federal department Hiral Patel, Shikha Mohta and other people who are involved with this fraud  hired foreign workers that too mainly from India with false IT expertise, then sponsored them H-1B visas by showing that they had a job opportunity with SCM Data Inc and MMC Systems Inc clients in US. They falsely represented that the foreign workers had full-time positions and were paid an annual salary while submitting the paperwork to the Department of Homeland Security(DHS).

Apart from these H-1B visa violations, these conspirators paid  the foreign workers only when they get a job with a third-party client who are in contract with SCM Data Inc or MMC Systems Inc. They generated false payroll records to create an impression that foreign workers were paid full-time wages.

Conspirators allowed foreign workers to submit bogus payroll checks to the Department of Homeland Security(DHS) as a proof that they were doing a full-time work even though they haven’t had any job with SCM Data Inc or MMC Systems Inc or with its clients.

  2. There are many consultancies are like this. The consultancies, who ever asking money for filing the H1B belongs to these category but still people are filing with them.

      agreed. these fake scammers are taking up so much of H1B. i bet if they go after all of them we wont need to do a H1B lottery.

    These kind of defaulters just spoil the credibility & trust of other employers in the market with similar LoB….Borh SCM Data and MMC System should be ordered to shut off

  5. sad… they should all be permanently barred from entering the usa… including the h1b holders who were part of this.
