I-140 EAD Rule cleared in OMB!

WOW!! Here is the good news regarding I-140 EAD Rule. As everyone was waiting since long to hear something positive about this rule, we are here with this great news. 


The Office of Management and Budget (OMB), on December 22, 2015, finally approved this rule which was proposed by the US Department of Homeland Security (DHS) in November, 2015. No complete details have been disclosed about this rule yet. This rule will be published soon in the Federal Register and there will be a commenting period.

As per some sources, They are predicting that this rule might allow certain I-140 applicants (immigrant petition for alien worker) to get work authorization. And any type of unnecessary restriction imposed on changing jobs or careers will be removed with application of this rule. We can only confirm the above predictions once the rule is published in the Federal Registry.

Additionally, this rule will be beneficial for those workers who are facing lengthy adjustment delays.

  5. How long will get EAD;  (for 1 year or 2 years)?

    What happen after validity expired? How many time we can apply or renew?

    If change employer then will new employer need to re-file GC again from the start Labor and I-140?

    Will old GC valid and no need to re-file?

    Will Spouse still be valid to get EAD, In case Husband H1B expired but have EAD based on I-140?

     

  6. TO me this looks like a bad news 

    1. Few months back there was an announcement for new EAD cutoff dates(visa bulletin changes) and those were taken back to 2009 after initially published that candidates with PD with up to 2011 can apply .

    what this EAD for IApproved 140 compelling reason means ?It looks like #1 above will not move much saying “There is a EAD for approved I140 with complling readon ” and EAD for Approved I140 compelling reason will be not given to everyone unless you have a compelling reason!! so it’s like a Deadlock ???

  7. Is it clear what does it mean by "certain I-140 applicants to get work authorization" ? with the 'certain' word looks like it would be very few people who will get the benefits

    Does this rule allowed flexibility to change employer and still we can maintain I -140 Approved, ?

    Do we required to file PERM Labor and I -140 again ?

Need to wait for the language I think, the "compelling circumstances" and "renewal  within one year of PD" doesn't make any sense.  Suppose one gets EAD for two years and takes up a new job,  when it comes to renewal what will happen if PD is not within 1 year ?  The person loses the job, EAD and becomes out of status ?  Also what will happen to H1 ? Looks like we will still need to hold on to H1  while we are in EAD and pay hefty renewal fees and still maintain terms and conditions of H1 ?
