I would suggest you to avoid that. It is immigration fraud and USCIS is scrutinizing people who got CPT from day 1. I personally know people who got RFEs.

No offense to honest fellows here with Indian passports, but just take a look at top 10 H1B position/petition holding companies and check how many of them are IT-ICCs (Indian consulting companies). It’s just ridiculous.
IT companies are necessary. But what is not right is people faking their credentials with the knowledge of consulting companies. Hell, some consulting companies ask people to fake credentials because they earn through their contractors. Legally and morally wrong.

Hi As i am AD/PP/VT applicant, and as I have not got any update from employer/attorney regarding check cash or SEVIS update from DSO, can I assume I am not selected and try for job change? I am currently on OPT extension with 1 year left. My packet has not been received yet by my company, so can I try to change job, I have one offer in hand, I am planning to have start date from June 1st week. Is it safe to do so? if I change my job, then my employer would ask USCIS for H1B Withdrawal right? But if it is not picked up, can they still withdraw? I will be giving them 2 weeks notice on this Monday/tuesday for leaving job based on your advice. Please advise what to do, I am not hopeful about H1 and I have got good job which I really dont want to lose. Thanks.
Once I tell them that I will be leaving job, then I will also have to tell them in case if my application gets picked up and they get receipt no. and if I have left the company, I will have to request them to withdraw it , right? Because technically legally, I cant change job with H1B processing undergoing. so before I get into trouble, I would have to ask them to withdraw, is that correct? So I can safely work on OPT.

Receipt dated 1st May received yesterday, it was non AD RP, receipt series is 149……hence though the frequency has declined but it is still pouring in.

I am a Ad/RP/VT with my undergrad from IIT and graduate degree from UT Austin. I have never paid for my education (always been on scholarships/fellowships). I have not yet heard about my visa status (which possibly indicates a rejection).
I am thinking about starting a petition addressed to President Obama to allow people with advanced degrees to stay in the US beyond the expiry of their OPT on the following grounds:
Professional: As advanced degrees indicate, the people who were not selected in the lottery are highly qualified whom their employers cherish having and who contribute to the US economy in a great way. So, it is beneficial for the US to retain people with such qualifications.
Humanitarian: (1) Most people with PhDs get married during their Phds and some of them even have kids, who if born in the US are American citizens. Now if the parents are from country X and country Y, and one or both of them has to go, then it is a family calamity. (2) Many advanced degree holders have paid a fortune or taken huge loans to study here. If their staying and working in the US represents a win-win situation, wherein they manage to pay back their debts and the US benefits from their high level of skill, then there should be no reason as to why they should not be allowed to stay and continue till suitable/appropriate immigration laws are passed.
If I receive overwhelming response from you guys, I will start this petition and circulate on FB and Twitter.
Please be serious and respond. I would not appreciate any silly comments.
I totally agree with you. I think people with a U.S master’s degree should have an option to work in this country when they are out of the college. With the H1B visa , it is becoming a crisis situation, helpless and leaving everything to sheer luck! This should have some solution.

I understand your concern and i totally believe in what you are saying. There has been a petition already created for this

I believe that they should at least increase the quota for h1b. Even i am on STEM extension OPT. My current OPT expires on 1st June, 2014. This was my first and last chance to file for H1b. Even i have an educational loan back home. I don’t know what i will end up doing. The other thing I cant afford is having a second masters degree or a phd degree as i believe the next year there would be more than 200000 applications for h1b which will be much worse than this year’s application. And also after some research i found out if you are having a masters degree and pursuing another masters degree, you are not allowed to have another period of OPT( so that’s much worse).
I understand your concern. I have seen from 2 years, there are so many petition already present and i have signed many . I see no change till now. Indeed i wasted my 2 years in this lottery process.I cant afford for higher education fees, seeing this lottery process i am afraid to take loan and study .So all together life is a mess in USA that s also i can say .Where ever you go and what ever u want to do only if ‘s and but ‘s of rules. For this.. It’s better to go back to your motherland and serve there for free. Who knows your life can change there. Why do you want to waste your time, keep your expectations high and finally blame other country’s process and rules. You know that there is only less chances of our applications to pick in lottery. Then why do you wanna raise petitions for that. US has many other problems to face daily. They don’t see whether the job is to be done by NON AD/AD. Finally they need there job to be completed with limited man power.
I totally agree with you. ALL advanced degree holders should be granted H1B, if the employer is willing to sponsor. After all, the willingness of the employer indicates that the candidate’s skills are valued in the US. IT outsourcing companies are applying for visa in bulk in the general category – many a times, the H1B holder does not even come to the US. Advanced degree applicants have spent so much in getting that degree. Compare that to an IT engineer working in India, who will be sent onshore for some work – he/she already has a job in India…if he/she misses coming to the US due to visa issues, it won’t make a big difference to him or to the service provider. If a person who is already employed by a US firm on OPT has to go back, it is a double whammy – both to the individual who has taken huge debts and now faces an immediate uncertain future as he has to leave in a hurry, and also the company which had trained that particular person and hired him.
I would say there should not be any lottery for H1B applicant who are already living in US and applied for H1B irrespective of their current status.

I got my receipt today. AD / RP / CA. Received Date is 4/10/2014 and the Notice date is 4/23/2014. It took 12 days for it to reach my attorney. My SEVIS record was updated on 04/28/2014. Hi i got receipt almost before 15-17 days but still i am not able to track status on USCIS website. i didn’t have any update after that. i have filed in premium processing, Vermont center. My check almost get deducted before 10 days.

Form last 2 weeks my employer have been telling me that Premium processing check got deducted but he did not get any email from USCIS. Most of friends got their receipt number. some of my friends told me my employer is playing with me. I know how much painful it is. I pray to god all of the guys who have been suffering like me, will get relief with a good news like what i have got today. good luck guys…

Yes you can. Talk to your employer, he can submit the necessary papers and check for premium processing to uscis. Not all employers pay the premium processing charges, since its your choice, you might have to pay that fees from your pocket.

According to my DSO even if we get through the lottery, usually SEVIS record won’t get updated before the receipt mail reaches employer.

I meant to say, it doesn’t always get updated before the receipt reaches. So no updates in SEVIS record doesn’t necessarily mean not being selected in lottery.
btw, when did you get to know about your sevis update?
There was no update last week and this Monday that is the 28th there was an update for change of status pending. I am on AD / RP / CA

Dont worry, u can go and come back before mid of jun. So that u get new i 94 . You will be receiving an RFE on request for existing new I 94 . As your old one which is been filled with your petition is expired. Just once u r back from india. make sure to make a copy od ur new i 94 and u can submit this as a proof to the RFE. Have a happy trip to india.

there is no logic to your earlier post and no trace/proof that ABOUT(?) 60k receipts are sent. (what is this ABOUT???? and ROUGHLY)
USCIS have not disclosed any information like this.
However simplest way to INTERPRET the receipt number is EAC xx xxx 5xxxx; where EAC is the code for Vermont Center (WAC for California). First to xx are the fiscal year number, in this years case it would be 14, second xxx group represents business day of the fiscal year (a fiscal year starts on October 1st and ends on September 30th of next year, in this case October 1, 2013 to September 30, 2014) (this excludes Saturday and Sunday unless and otherwise notified by USCIS that they were working on any of these two days particularly) next group starts with number 5 followed by xxxx, for I-129 (which is your application of H-1B) petition it ALWAYS starts with 5 followed by xxxx is a count. Thus xxxx can run from 0000 to 9999 for a particular day since the lottery has been drawn.
Now I don’t think anyone “AND YOU TOO” but USCIS have this count.
Anyone who have received receipt numbers can check this logic to verify if this information is incorrect. Meanwhile Roopam; DO NOT PROVIDE WRONG STATISTICAL INFORMATION, unless you have any proof to support it.

Hey, my company filed for 2 candidates under Advanced degree cap including me. The other chap received the received but I didn’t. This means mostly I should keep my hopes down right? because I think that USCIS is sending receipts company-wise/attorney.

No, I don’t think they are sending it company or attorney wise. Here is the reason why I am thinking so. Some of my friends in my company got their receipts on Tuesday morning. And I got my receipt on yesterday. I compared the EAC number on the other receipts mine is like 55XXX. The first person who got the receipt has 52XXX. This clearly shows that they are sending them in the order they have. If you are in AD Cap sit tight, you still have chances. You can keep your hopes until May 2nd week. because your application might be in waiting list. Who knows. Just wait…

My company is not revealing the information of when the check got cleared. I checked my SEVIS after getting this receipt. My DSO said there is no update on SEVIS. This is the same case with two of friends in other university. They are in their cap gap period, and they have received their receipts. Their DSO is not giving them new I-20 saying that, SEVIS is not yet updated and they need to wait until the SEVIS is updated. 13 of my friends applied for H1-B, 12 got receipts till date. This makes me think changes are high for AD processing.

Yes. It is in initial review. My employer gave me the receipt after he was able to check the status in USCIS( which is stupid). Recently he told me that he got the receipt three days before he gave me.
If you have a receipt, give it 3 to 4 days to get updated in the system.

As per last year’s forums, those who were not selected in the lottery started getting returned packets after May 15th.

Talk to your employer about which attorney they used to file the cases and talk to the attorney directly.
In my case, my company goes through an external agency for filing h1b and i talk to them directly for any updates and there is site for it as well to check for updates.

There is no receipt numbers or anything. My company uses VISANOW. Only people who have applied through this agency can view and communicate with them. Apart from them no one can. My company is pretty open when it comes this. I can see the fee paid to the attorney and everything. So its pretty transparent. There are other agencies like these which companies use. So talk to your HR.
My company also uses VISANOW. They keep posting that we will know by early may and they never check the status of our checks if they have been cashed out

Only USCIS can answer the question for sure. Usually they will come up with a statement once they finish sending receipt notices for the selected candidates. Until then it can be assumed that there are receipts to be sent

no, it doesn’t work like that. AD applications go though 2 lotteries0 both of which were conducted and results are coming out now.
You need to calm down. Hardly any of the RPs have heard. My attorney told me not to expect anything until next week. There are 20,000 of these visas, plus the ones selected under the regular cap. Your hope isn’t fading, you just didn’t hear in the very first wave. Remember, the PP people began hearing on the 12th and were still receiving positive receipts yesterday.

AD/RP. I have seen people getting AD/RP receipts on this forum and also I know many who got. See the poll above. If it does not work out have to go on opt extension if it is granted. Or all the hard work till today goes to waste.

From what I’ve seen from this forum and others, people with AD/RP started getting confirmations since Friday. I got mine today around 3 pm! AD/RP/Vermont. Still time though…I’m sure it takes a while for them to notify everyone….good luck!
Yes I think there is still time. I would give it until Thursday before worrying. Premium processing receipt took 1 week to be sent out. I think they only started sending the Regular processing receipts last Friday (That’s when my employer’s checks were cashed in) So it should take a few days. Be patient. Good luck.

Postal mail. Both my Lawyer and Employer received the I-797C notice today. My employer’s checks show to have been cashed in Friday, so I suppose that the receipt was mailed then.

Actually, its really hard to say at this point of time. Not sure if anyone under RP got the receipt till now. Since USCIS starting premium processing next week, they should be busy sending out the receipts for PP guys and also you might see few RP guys getting receipts this week hopefully. But nothing is sure….!! Good Luck.
I have come to know a few getting their’s today. Have not heard back anything from lawyer yet. This process is horrible.

Hi, I just got physical letter from USCIS containing the Receipt Notice (I-797C)…Mine was California Service center, Regular Processing, Advanced Degree (US Masters Cap), …Got Selected into the Lottery…Phew!!! All the best to all..I wish everyone gets selected !!!

USCIS shared the news today that they will start premium processing from April 28 and respond in 15 calendar days ..
Wrong info Anu…. USCIS have mentioned almost 2-3 weeks back that premium processing will start NO LATER THAN 28 April. By which means those who applied under premium processing can expect to receive receipt numbers (by email) late by late on 28th April. And processing of those applications starts and reply will be sent to those on or before 15 business days from the received date mentioned in that email.

Dude..be content with what you got..why u need more H1Bs and loot all jobs in US.Leave few them for as well..For the population of India/China, the cap count will always be less no matter how much they increase.

My petition got picked in the lottery! 🙂 Lawyer and HR rep sent out an email from the Vermont Center confirming the EAC number this morning Eastern standard time at 10.19am! 🙂 (NYC). Petition was filed for US Master’s Cap-Premium processing. One hurdle down-now on to the next one.

Yes. It included my name, DoB, who petioned, date received. The mail got sent to my attorney who then forwarded it to me and the HR.

USCIS has just set an expectation for you that they begin the processing on April 28th but the actual processing starts once the lottery is done.

It is not an expectation. 28 is the date on or before USCIS will be starting processing the document. Nothing is assumed or expected. They have explicitely mentioned this on their website.

Oh Man..I have no idea, may be they didn’t really read all the options properly or word “waiting” in the multiple options poll. As far as i know from seniors who applied before, that they will send hard copies of regular processing in-case we are selected and that would happen after all premium processing is taken care off AD or not. Now the question comes whether lawyers receive the receipts, we will or the employer will. I did some research last year i saw someone getting a regular processing receipt on 18th April. That means regular processing AD should be getting something somewhere around this or next week. Also in the mean time please sign this petition.
